The current administration has announced a significant shift in policy regarding the enforcement of Title IX protections for transgender students in public schools. This change means that the protections previously extended to LGBTQ+ students under Title IX will no longer be recognized or enforced at federal levels.
In June 2022, under President Joe Biden, Education Secretary Miguel Cardona expanded the interpretation of Title IX, a landmark 1972 law that prohibits sexual discrimination in federally funded schools, to include protections against discrimination based on sexual orientation and gender identity. This decision was influenced by the Supreme Court’s 2020 ruling in the case of Bostock v. Clayton County, which expanded Title VII's workplace discrimination protections to encompass sexual orientation and gender identity.
However, this new policy has been overturned by the administration's directive, which aligns with an executive order emphasizing "biological truth." This order, which recognizes only binary sexes as "male and female," has been described in the administration’s communiqué as a foundational reality that is "not changeable." The directive asserts that the President has the constitutional authority to interpret the law, hence reversing the previous administration's broader interpretation of "on the basis of sex."
The directive also cites a recent Kentucky District Court ruling from January 2025, which deemed the Biden administration's interpretation of Title IX unenforceable, arguing that the expansion of "sex" to include "gender identity" fundamentally alters the intended scope of the provision. According to the notice, extending protections in this manner distorts the original intent of Title IX.
The current administration’s order also seeks to roll back transgender-inclusive policies and initiatives aimed at combatting racism in K-12 education. It proposes to withdraw federal funding from schools that adopt transgender-inclusive policies, enforce mandatory disclosure of students' gender identity to their parents, and accuses educators who support transgender students of misconduct.
Emma Grasso Levine, a senior manager at Know Your IX, expressed profound disappointment in the administration's decision. She stated, "This decision is devastating for many students, particularly survivors of sexual violence, LGBTQ+ individuals, and pregnant or parenting students, who rely on these protections to safely pursue their education." She urged educational institutions to uphold student protections despite the lack of federal guidelines.
The policy shift has also affected Department of Education employees. Reports indicate that numerous employees who participated in diversity training programs during the previous administration's term have been placed on administrative leave. This is seen as part of a broader effort to dismantle initiatives focusing on Diversity, Equity, and Inclusion (DEI).
The current administration's stance reflects a broader agenda to restore policies from its first term, which included enhancing the rights of students accused of sexual misconduct and limiting institutional accountability in such cases. The implications of these changes are far-reaching, with potential impacts on the safety and wellbeing of marginalized student populations.
